Perth Subdivision Process

Green Title / Survey-Strata

1. Contour Survey | Feature Survey by surveyor

2. Subdivision design & assessment - Green Title or Survey-Strata

3. Application to WAPC - 90 day statutory time period

4. WAPC refers the application to relevant Authorities including but not limited to:

-Local Authority *

-Water Corporation *

-Western Power *

-Main Roads WA

-Department of Environment

-Swan River Trust

* usual Authorities

 

5. WAPC issues determination of Application. Generally Approval or Conditional Approval.

 

6. Owner / developer satisfies WAPC conditions. Standard conditions may include but not limited to:

-Payment of Water Corporation Headworks

-Sewer junction/connection for each lot

-Provision of underground power- existing building(s) to be connected to underground supply, distribution board for Survey-Strata of more than 2 lots

-Existing dwellings to comply with R Codes - car parking, outdoor living area etc. or demolition

-Upgrade of crossovers

-Construction of battleaxe access legs

-Outbuildings and materials removed from proposed vacant lots and any battleaxe access leg

-Geotech Report - earthworks depending on Geotech results

-Drainage

-Public Open Space

-Construction of new roads and services - sewer, water, drainage, gas, telstra etc.

 

Each Local Authority imposes different conditions depending on the characteristics of your property, their Town Planning Scheme and Policies. It is important to contact your Local Authority prior to submitting a subdivision application so you are aware of any possible conditions.

 

7. Owner/ developer requests Licensed Surveyor to survey property to mark boundaries and prepare subdivision plan.

 

8. Owner / developer provides Surveyor relevant information to request subdivision clearance from each Authority.

 

9. Licensed Surveyor lodges clearance letters to WAPC and lodges Deposited Plan or Survey-Strata Plan at Landgate. An application for titles can be lodged at the same time (Lot Sync). The Application for new titles can be prepared and lodged by the owner, Settlement Agent or Solicitor.

 

10. If Plan is lodged under the Lot Sync method, Landgate will examine the Plan, WAPC will endorse the Plan and then Landgate will issue the titles. This process usually takes about 2-4 weeks depending on backlog. Times may vary.

 

11. If Plan is lodged without the application for titles (Normal method), Landgate will examine the Plan, WAPC will endorse the Plan and then Landgate will place the Plan 'In Order for Dealings'. An application for new titles can then be lodged at Landgate. This process takes about 4-6 weeks. Times may vary.

Built Strata Subdivision Process

1. Contour Survey | Feature Survey by surveyor

2. Builder, Designer or Architect designs development.

 

3. Development Application to Local Government.

 

4. Building License Application to Local Government

 

5. Site preparation by Builder and boundary survey by Licensed Surveyor. Buildings may be setout by surveyor at this stage also.

 

6. Construction of buildings.

 

7. Licensed Surveyor is engaged about 2 months prior to completion of the buildings to undertake Built Strata measurements to prepare the Strata  Plan.

 

8. If the development has more than 5 dwellings, is commercial or greater than 2500m2 , delegated WAPC approval is also required. A Form 24 application will have to be submitted to Council for Planning Approval. This approval process can be about 6 weeks. Approval is issued on a Form 26, and is issued once all Planning conditions have been met.

 

9. A Building Surveyor is engaged once construction is completed to inspect the Buildings to ensure they have been constructed in accordance with the Council approved plans. The Building Surveyor will issue a Certificate of Building Compliance (CBC - BA18), if the buildings are compliant.

 

10. The Licensed Surveyor then submits the Built Strata Application (BA11 or BA15- depending on the class of the buildings) to Council along with the BA18 certificate and other relevant forms and documents.

 

11. Council will check that all the Planning conditions have been met on the Development Approval and then issue their approval (BA12 or BA16 - depending on the class of buildings). Generally the BA12 or BA16 and the Form 26 are issued at about the same time.

 

12. The Licensed Surveyor can then lodge the Built Strata Plan at Landgate with the neccesary Forms. An application for new titles can be lodged at the same time (Lot Sync).

 

13. Landgate will examine the Strata Plan and then process the Application to issue titles. This process usually takes about 2-4 weeks. Times can vary.

 

14. If the Strata Plan is lodged without the application for titles (Normal method), Landgate will examine the Strata Plan and then place it ' In Order for Dealings'. An application for new titles can then be lodged at Landgate. This process takes about 3-5 weeks. Times can vary.
